Contract for Commissioned Art Work

This is a legally binding Contract between Jud Turner, sculptor, LLC (referred to as “Jud” from this point forward) and _________, (referred to as “Customer” from this point forward). This Contract regards the creation of art work (referred to as “Project” from this point forward) based on a request the Customer has made of Jud.

 


OVERVIEW

The Customer has requested that Jud make __________, for a total cost of _____ (does not include shipping, please see below for shipping info) The sculpture is to be made of MATERIALS HERE, and will be SIZE HERE. The finish for the Project will be FINISH DESCRIPTION

The approximate date of completion will be TIMELINE HERE. Customer acknowledges that the time line is Jud’s best effort at getting the The Project done by the estimated deadline, but, in the course of making art, many unplanned things can happen that add time to the Project. If the time line for completion of the Project is going to exceed the original estimate, Jud will communicate this to the Customer no later than the original date estimated for completion, and provide a new date of completion. 

 

 

SECURITY DEPOSIT:

Before Jud can begin the Project, a Security Deposit of 1/3 (___) of the total cost (____) of the Project must be paid to Jud. This Security Deposit is to cover some of the costs that will be incurred by Jud up front, such as Materials (i.e. - steel, welding supplies, studio space), and Labor (researching images, preliminary drawings, creation of the Project).

This Security Deposit is NON-REFUNDABLE (with the exception of Projects which can be resold to other interested parties - see “REJECT/RESALE/REFUND” section below.)



COMPLETION OF THE PROJECT:

Once Jud is done with the Project, he will notify the Customer via email (unless other method is requested by Customer), and post digital photographs of the Project on the Internet for the Customer to look at and judge. These photographs will be posted at a part of Jud’s Internet sculpture gallery (http://www.judturner.com) that is not linked to the public part of the website. The web page with photographs will include specific information about payment, including where to send check / money order, or an option to pay online using a credit card.  

 


APPROVAL OF THE COMPLETED PROJECT:       

If the Customer approves of the Project, the remaining 2/3 of the cost (___) payment can be made using the options provided on the web page (other arrangements possible too). Once payment is made, the Project will immediately be shipped (see SHIPPING below) to the Customer.

 


DISAPPROVAL OF THE COMPLETED PROJECT:

If the Customer disapproves of the Project, for any reason, the Customer will inform Jud that the Project has not met the expectation of the Customer (using email, letter, or phone).

       If the Customer has specific suggestions about changes to the Project which could increase satisfaction, those suggestions should be communicated to Jud when informing him of dissatisfaction. At that point, there will be a dialog about the changes the Customer desires, Jud’s ability to make those changes or meet Customer expectations, and possibly the need for additional money to cover unanticipated, additional labor costs.

       If the Customer disapproves of the Project, for whatever reason, then the Security Deposit will be retained by Jud (to cover material and labor costs incurred by Jud) and the Customer will have no further financial (or other) obligation to Jud. Ownership of the Project will be retained by Jud, and the Project may be resold by Jud. (see “REJECT / RESALE / REFUND” section below)


 


REJECT / RESALE / REFUND

If the Customer has rejected the Project, and Jud is able to sell it to another interested party within 90 days , then Jud will refund the Security Deposit paid by the Customer. The resale, if it happens, will occur via Jud’s Internet sculpture gallery (http://www.judturner.com). If resale occurs, Jud will notify Customer immediately (using email, letter or phone). 


PAYMENTS / REFUNDS

Payment can be made using money order, check (mail) or electronically, using a credit card and the 3rd party payment system, PayPal (for more information about PayPal, please visit http://www.paypal.com/ )

 

       To pay by check - enclose a check made out to “Jud Turner” with this Contract when mailed back to Jud.

       To pay by credit card online - contact Jud by email or phone (see below for contact info), and a special web page will be set up for payment using PayPal.

       Refunds - (if needed) will be payed to Customer by either check (mail) or credit card (PayPal) based on Customer preference.



SHIPPING:

The Project will be shipped to the Customer once full payment has been made. The cost of shipping will be SPECIFY HERE. The Project will be shipped via US Postal Service, Priority Mail, and the shipment will be insured to cover both Customer and Jud in case of any loss or damage during shipping.
